- الهدف الأساسي للرخصة هو نشر العلم تقرباً لله سبحانه وتعالى
- أن بنود الرخصة تتعلق بتقيد استعمالات مشروعة أصلاً، فالرخصة لا تحوّل عمل غير مشروع إلى عمل مشروع.
مثلاً إذا كانت الأبحاث الجينية والاستنساخ غير مشروعين في بلد ما وكان هناك برنامج خاضع للرخصة تقول “يسمح استخدام البرنامج لأي هدف” هذا لا يجعل الأبحاث الجينية والاستنساخ في ذلك البلد مشروعة
- أن الرخصة تتعلق ببرمجيات من السهل نقلها من خلال الإنترنت عبر مناطق تخضع لقوانين مختلفة لدرجة أن ما هو خير في أحدها جريمة في أخرى. لهذا يجب أخذ ذلك بعين الاعتبار من خلال صيغ تشبه “إذا كان أحد البنود لا يمكن تطبيقه في بلدك فإنه …” أو “إلى أقصى حد يسمح به القانون المعمول به في بلدك”
- إدراك أن الرخصة “عامة” أي قد تستخدم على أنواع مختلفة من البرمجيات لهذا فيتوجب علينا عمل تصنيف للملفات ومراعاة الفروق بين الأنواع المختلفة ومنها
- كود مصدري لبرنامج معين.
- ملف ثنائي تنفيذي
- مكتبات ثنائية تنفيذية
- نصوص تنفيذية (سكربتات)
- بيانات خام بهيئة نصية يتطلبها عمل البرمجية (مواقع مدن، ملفات إعدادات، …إلخ) أو تجعل عمل البرنامج أفضل.

- التحفظ على الملكية الفكرية والقوانين الوضعية التي تتعامل معها مع التأكيد على عدم نفي أو إثبات مشروعيتها لأن ذلك خارج عن مجال scope الرخصة
- إدراك معاني المفاهيم والمصطلحات كما هي معرفة في القوانين وعدم الانقياد للكلمات الخادعة مثل سرقة وقرصنة …
- إدراك أن الرخصة تبنى على حسن الظن
- إدراك أن غلبة الظن على البرمجيات عدم إمكانية استخدامها في الشر بسبب الطبيعة غير المادية لها (مثلاً برنامج التقويم الهجري)
- إدراك وجود مخربين في الإنترنت بل ووجود تخريب منظم ومتعمد تموله جماعات مشبوهة (مثل عبث المنصرين في مواقع الويكي)
- إدراك أن هناك غير مسلمين قد يرغبون باستخدام البرمجيات والانتفاع بها وأن ذلك قد يكون باباً لهدايتهم وتمرير رسائل دعوية لهم.
- إدراك أن الوقف ليس بالضرورة عاماً فهناك وقفاً خاصاً كأن يكون للمسلمين فقط أو لأشخاص بعينهم وأنه قد يوجد من يرغب بإطلاق برمجيات موقوفة وقفاً خاصاً مجاله ليس كل الناس
- إدراك أن الملاحظة السابقة لا تكون من خلال رخصة “وقف” العامة خاصتنا. بل من خلال رخص مشابهة أكثر خصوصية.
- التأكيد أن الهدف هو نيل رضى الله لذلك فإن أي عوامل أخرى يجب أن لا تتعارض مع هذا الهدف (مثل التوافقية مع معايير OSI أو FSF ..إلخ)
- ملاحظة أن غير المسلم غير مكلف في الشريعة الإسلامية وأن بعض القواعد الشرعية تنطبق على بعضهم بموجب عقد الذمة لمن هم من أهل الذمة.
- إدراك أنه قد يوجد من غير المسلمين من يريد إطلاق برامج وفق رخصة وقف مع ملاحظة:
- أن النية هنا تختلف (ليست بالضرورة التقرب إلى الله)
- أنها لن تقبل من غير المسلم يوم القيامة
- أن غير المسلم يثنى عليه إن تصدق أو قام بالخير وهذا جزاؤه الدنيوي مما فعل. وذلك قد ينطبق على رخصة “وقف” العامة (وقد لا ينطبق. ذلك بحاجة لمتخصص في الفقه)

كرأي أولي : قد قرأت سابقا رخصة GNU المترجمة للعربية وخاصة الإصدار الأخير وأتت شاملة للكثير من الجوانب الفنية والقانونية فاقتراحي هو أن تُطوّر رخصة وقف وتكتب كالرخصة العمومية ( فهذا ينقص عبء كبير ) مع زيادة الخصوصية لرخصة وقف في أن لا تتعارض البرامج وأهدافها واستعمالاتها مع الشريعة الإسلامية.
والعقد شريعة المتعاقدين ، فمن أحب رخصة وقف فيستعملها ومن أراد غيرها فلديه رخصة GNU.
رخصة وقف غير متوافقة مع رخصة جنو, و هذا برأيي لا بأس به فاصلا رخصة وقف يجب ان تستخدم للبرامج الاسلامية, المشكلة طبعا اذا كانت تستخدم مكتبات مرخصة فقط برخصة جنو, اقصد طبعا GPL
التعارض يحدث بالتحديد في هذه الفقرة: “ﻻ يجوز استخدامه فيما يسئ للأخرين أو يخالف مبادئ الإسلام”
فهذا يعتبر قيد restriction اضافي غير موجود في الـ gpl, و هذا يجعلها متعارضة مع gpl لان gpl تشترط عدم وضع اي قيود اضافية غير المذكورة في gpl.
كما ان هناك اشكال قانوني فهذا النص عام و مطاط بعض الشيء و الله اعلم.
كما قلت نحن لا نهتم بمطابقة FSF و OSI لكن من حيث المبدأ أريد أن أعرف ما هو الفرق بين هذا البند وبنود export restrictions في فيدورا وفي code.google.com ومطابقة القوانين الأمريكية في رخصة موزيلا ومطابقة قوانين ولاية ما في ويكيبيديا …إلخ.
